General terms and conditions for the Zenjob referral program

Zenjob SE, Saarbrücker Straße 21, 10405 Berlin (hereinafter “Zenjob”), operates a digital platform for the temporary staffing and placement of personnel. To promote growth, Zenjob offers a referral program in which eligible app users (hereinafter “referrer”) can refer friends using a referral code (hereinafter “referee”). Both parties receive a bonus upon successful registration and fulfillment of the criteria. These General Terms and Conditions of Participation (hereinafter “T&C”) govern the legal relationship between Zenjob and the parties in its entirety.



Definitions

The following definitions apply to these terms and conditions of participation:

1.1 Zenjob Referral Program: is an initiative by Zenjob where selected app users can invite friends to also register with Zenjob, work shifts and receive a bonus for doing so.

1.2 App users: already registered users of the Zenjob app. 

1.3 Referrer: from Zenjob for the respective campaign selected App user who invites friends to use Zenjob.

1.4 Referee: a person who is not currently registered with Zenjob or has never been registered with Zenjob and receives an invitation to register with Zenjob from the recommending person.

1.5 Successful referral: A referral is successful when the Referee registers in the Zenjob app using the referral code and meets all criteria displayed during registration within the campaign period. If one criterion is working a shift, then the shift will not count if it was cancelled, not worked at all (no-show), or only partially worked (e.g., shortened).

1.6 Bonus: is the monetary reward granted to both the referrer and the referee.

1.7 Campaign period: is the period in which both parties must meet the criteria for a successful recommendation.

Eligibility and duration

2.1 Any app user who receives a request to refer a friend is eligible to participate.

2.2 Both the referrer and the referee must i. be natural persons, ii. be at least 18 years old and iii. be resident in Germany.

2.3 Participation must take place during the campaign period. The respective campaign period will be displayed to the referrer in the app and to the referee upon registration in the app.

Recommendation process

3.1 Referrers will see the referral code in the app. The referral code is only valid during the campaign period and expires afterwards. The code can be shared with a maximum of 10 referees per campaign period. If the referrer is selected again for a specific campaign, the code will be reactivated for use again.

3.2 Referrers can copy the code in the app or share it directly with the referee via their preferred messaging service. Referral codes may only be used for personal purposes. Any commercial use of the Zenjob Referral Program is expressly prohibited. Referral codes may not be publicly distributed or published. Distribution via platforms such as coupon websites, blogs, Reddit, Wikipedia, or social media (in a public format) is therefore not permitted.

3.3 Referees must enter the code in the app during registration to qualify for the bonus. Adding the code retroactively is not possible.

3.4 Both parties will be informed of the respective criteria for a successful recommendation, such as the number of shifts to be worked, specific locations, etc.specifications for the shifts, certain jobs categories for the shifts, the campaign period, and other criteria are displayed in the app. The criteria that apply are those displayed to the parties in the app at the start of the campaign/during registration. Zenjob is permitted to redefine the criteria from campaign to campaign; for an ongoing campaign, only the criteria displayed at the beginning of the campaign apply. All criteria displayed in the campaign must be met within the campaign period for a recommendation to be successful.

Bonus  

4.1 If the referral is successful, i.e., all criteria are met, both parties will receive a bonus.

4.2 The specific amount of the bonus payment will be displayed to the parties in the app for the respective campaign.

4.3 The bonus will be paid after the end of the campaign with the next payslip.

4.4 The bonus cannot be exchanged for cash or other benefits of monetary value such as vouchers. Furthermore, the bonus cannot be transferred to another person.

4.5 If shifts are cancelled, not shown (no-show), or not performed as agreed (e.g., shortened), the requirements for a successful referral are considered not to have been met. In these cases, there is no entitlement to payment of the bonus.

4.6 Zenjob is entitled to withhold or reclaim a bonus if the conditions for a successful referral were not met or have subsequently ceased to exist, in particular if the referee is or was already registered with Zenjob or if the referral program was misused.

Data protection

5.1 When using the referral code, the referrer is responsible for ensuring that the code is only sent to referees who have consented to being contacted (no spam). Zenjob assumes no responsibility for how the referees are contacted.

5.2 Zenjob only processes the data of the referee once they independently take action via the link and register.

5.3 The referrer will see the first letters of the names of the referee who used the code during app registration and met the criteria for a successful recommendation. This may allow the referrer to identify the referee. No other personal data will be shared.

5.4 Both parties will be notified if the criteria for a successful referral are met and they receive a bonus.

5.5 The data protection regulations of Zenjob SE apply.

Liability

6.1 Zenjob reserves the right to exclude participants from the referral program if they use the program in an exploitative manner, violate the Zenjob terms and conditions or applicable laws and regulations.

6.2 Zenjob is not liable for the non-receipt or errors in referral codes due to technical problems, network issues, manual human error, or other errors occurring during the campaign period. Participation is at your own risk. Zenjob assumes no liability in respect of the participation (or inability to participate) of any app user or referred person in the program, to the extent permitted by law, including direct, indirect, incidental, consequential, or other types of damages related to or arising from the program or your participation in the program. Nothing in these terms and conditions excludes Zenjob’s liability for damages resulting from injury to life, body, or health, breach of fundamental contractual obligations, or damages caused by intent or gross negligence.

Final Provisions

7.1 Zenjob reserves the right to amend, replace, or delete these Terms and Conditions at any time for legitimate reasons, particularly in the event of legal, technical, operational, or economic changes. Amendments will only apply to future campaigns. Zenjob will inform participants of any changes in a timely manner via push notification in the app or email.

7.2 Should individual provisions of these Terms and Conditions be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely reflects the purpose and intent of the parties when concluding these Terms and Conditions.

7.3 The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes is Berlin.
